Divorce Application
The divorce process can be initiated by either party unilaterally or jointly if an agreement was reached. Australia adopts the principle of no-fault divorce which means that the court does not consider whether a party was at fault for the breakdown of a relationship.

The only ground for divorce is a 12-month separation demonstrating an irretrievable breakdown of the relationship. It is still possible to apply for divorce if the separation is ‘under the same roof’.
